There's a new kid on the Blawg...

*drumroll*

Welcome, Accidental Lawstudent a fellow Law Conversion enthusiast/victim (delete as appropriate) who by the looks of it discovered the joys of blawgging as a useful procrastination tool in the countdown to exams.

Speaking of which, I tend to link to people who comment on my blawg but if anyone would like their link to be added to my blawg please let me know as I'm always happy to oblige :)

I shall now return to learn about legal things. Toodles!

Dear Susie Law School

It is 4.15 in the morning (Saturday) and I have just returned from an extended wine tasting.... with friends and other persons unknown.

While pink wine is not to my taste... your colour scheme does appeal, as does the content of the blog.

Having taught Contract for many years - the distinction between Invitation to treat and Offer came to mind - in relation to the invitation to write to be added to your blogroll. Was there any possibility of a uniltareal offer being applicable, I thought?

Then, of course, I had to think about consideration and that in turn led me to consider whether you had prescribed any conditions precedent or, indeed, express (I could find none - nor, for that matter could I find any exclusion clauses)... which in turn led me to consider what Implied Terms might apply and, in the event of such terms being implied, whether any action on my part, on your blog, by way of comment, or generally, may lead to breach.

It was at this point, considering discharge by breach and my exposure to damages and other remedies (at common law and in equity) that I came to the conclusion that my attempt to be installed on your blogroll may be frustrated by my inability to remember my own blawg URL.

One thing, for certain, it was clearly a mistake as to identity when I ordered the wrong wine earlier in the evening.

You may, quite properly,in the light of the foregoing, take the view that I should not be encouraged any further.

In which case - may I suggest that you estopp me from getting onto your blogroll.

As Lord Denning MR might have said, if he had been a 'blogger' : "EU law is "a tidal wave bringing down our sea walls and flowing inland over our fields and houses."

Denning also said this.... "It happened on April.... It was bluebell time in Kent"

Hinz v. Berry (1970) 2 Q.B. 40, 42

I regret, that I am not able, at this time, to consider the EU Law or Human Rights implications of my application.

I am now going to adjourn.... to rest... to rise on the morrow.

PS... Like the blog... :-)

Dear Charon QC

This is by far one of the best comments I've ever got, so you can most certainly be added. As consideration I would expect a link from your blawg to mine, but we could always decide that as a social arrangement there is no binding contract due to lack of intention to create legal relations.

Contract's my favourite subject so you're on to a winner there!

Go Lord Denning.

Dear Susie Law School

Past consideration is no consideration (Re McArdle et al)... as you know!

I have had your blog on my blogroll for a few weeks now - under the name "Legally Blonde in London"

Thanks for adding my blog... appreciate it... and keep up the posting!

Yes...having seen my comment in the cold light of day... I have to say... that it was a good night last night... whn I made my 'application'. Only glad there weren't too many typos in my comment!

Best wishes for your studies!

Thanks for the add, btw. Also: updated news about the mooting scandal! Might get a petition going just to keep things exciting during the long month of revision...
